The latest figures and statistics relating to employment tribunal claims (for the period April to June 2018) has been published by the Ministry of Justice (MOJ).

Since the ‘fees’ for making a claim were abolished, the number of claims has been increasing. The latest figures show that the number of single claims lodged increased by 165% compared to the same quarter last year.

The most common complaint was unauthorised deductions from wages. Disability discrimination cases had the largest average award
(£30,700). The average award for unfair dismissal awards was £15,007. Unsurprisingly, there is currently a backlog with outstanding claims rising by 130%.

On a more positive note, of the clams disposed of, ACAS pre-conciliation helped settle 25% of them.

But it’s not just the costs in terms of awards if you lose a claim – there are other costs in terms of legal fees (which you are very unlikely to get back even if you win!) your time, the distraction and worry.

It’s never been more important to get your HR in order and make sure you are protected. Good contracts of employment will help protect you against claims like unauthorised deductions and good HR documentation that is well communicated, will act as a shield and the first line of defence.

If all that fails, you can consider insurance against employment disputes – but having insurance will not protect you if you don’t have the basics in the place first!
